TERMS OF USE

General Terms and Conditions

These General Terms and Conditions, together with the Privacy Policy, govern the use of the online booking and mediation platform accessible via the website www.meteoraactivities.gr and other related websites and mobile applications published and supported by MeteoraActivities ("online platform").

Each end user who accesses, navigates, transacts, or uses the services of the online platform (hereinafter referred to as "visitor," "client," or "user" depending on whether they are merely visiting or making a booking/order of services) is deemed to consent to and unconditionally accept the following terms set forth herein, without any exception. In the event that the user does not agree with these terms, they are obligated to leave the website and refrain from any transactions or use of the services of the online platform.

The following terms exclusively cover the use of the online platform www.meteoraactivities.gr and the booking of various services through it by visitors. Under no circumstances do they apply to the execution of the mentioned activities and services by the partners.

About Us

The website www.meteoraactivities.gr is an online booking platform and an online travel agency with MHTE number: 07.27.E.70.00.00.838.0.1. and GEMI number, headquartered in Kalambaka, at 12 Diogenous Street, with VAT number 170345686 and Tax Office of Trikala. We are the managing entity of the Platform and bear the corresponding responsibility for it (hereinafter referred to as the "Provider," the "Platform," or "MeteoraActivities").

We manage the Platform as an intermediary platform where online tours, services, and activities are offered by various local Partners - Activity Businesses, tour organizing offices (bus tours, bike tours, horseback riding, etc.), car rental bookings, bike rentals, motorcycle rentals, sightseeing tours, and other services (hereinafter referred to as "Partners" or "Suppliers").

The online platform MeteoraActivities functions as an intermediary between you, the end user/Client, and the Suppliers/Partners. Therefore, when you book an activity through the MeteoraActivities online platform, you are booking directly with the Supplier/Partner. The descriptions, photos, and other content for each activity come from the respective Partners. Consequently, we cannot directly influence this content.

The Platform and the Partners are completely independent (freelance) professionals and are not connected by any employment relationship. The MeteoraActivities online platform acts as an intermediary between the Partners and the end users (Clients), and under no circumstances can it be considered a contracting party in the agreements concluded between them; the booking on the platform is equivalent to a direct booking with the responsibility on the Partners.

The Provider reserves the right to freely modify or revise the terms and conditions of use and transactions through the online platform at its discretion. The Provider also undertakes to inform the end users of any changes through the pages of this online platform.

What We Do

You can review all the Activities and Services offered through the MeteoraActivities Platform. The contract for the provision of the Service/Activity is concluded exclusively and directly between the Partner/Supplier and you, the Visitor ("Service Agreement"). When purchasing an Activity/Service through the MeteoraActivities Platform, you do not acquire any product or service from us, but directly from the Suppliers/Partners. The Service Agreements are made on our behalf and for the account of the Suppliers. We act as an intermediary electronic gateway between the Suppliers and the Visitors, and we are authorized by the Suppliers to conduct transactions directly between the Suppliers and the Users, such as booking and payment management. We do not provide activities and, therefore, are not involved in any Service Agreement with the Customer. We do not act as organizers, owners, resellers, or any other contracting party in relation to the Service Agreement. We receive a commission from the Supplier for the mediation we provide regarding the Service Agreement.

Through the MeteoraActivities platform, you can filter the list of Activities based on various parameters. The search guide will present Activities that meet your criteria and are offered by specific Suppliers. If more than one Supplier is able to offer an Activity that matches your criteria, the Activities will be displayed in order based on factors such as popularity, availability, rating, performance, and other parameters we deem appropriate.

To ensure a quick and smooth process, you can submit questions regarding your booking to the MeteoraActivities customer service. For this purpose, you can find a contact form on our website and call our help line. We usually respond within 48 hours at the latest. Additionally, you can contact the Suppliers directly. In case of an emergency, the contact details of each supplier will be sent to you after a confirmed booking.

No registration is required to access the platform. However, certain necessary information is required to confirm the booking. Subsequently, you will receive an email or SMS confirming the booking and including various details of it.

We reserve the right to restrict your booking for Activities or to cancel Activities you have booked if we suspect fraud, violation of the platform's general terms, or breach of obligations under the Service Agreement, which have been notified to the Provider.

We are not obliged to improve, extend, or upgrade the content, functions, and services provided through the MeteoraActivities platform. We reserve the right to discontinue our services and activities at any time, without the right to continuation. However, if you have already concluded a completed booking with a Supplier, the agreement remains valid only between you and the Supplier.

Booking Process & Payments

Using the MeteoraActivities platform is free, and creating an account (username and password) is not required for visitors.

For each Activity, the price offered by the Partner through the MeteoraActivities platform applies. The price you pay for booking an Activity corresponds to the Published Price minus any applicable discount. The Booking Price is payable immediately after the booking.

The platform has the right to collect the invoiced amounts on behalf of the Supplier, according to the agreements made between the two parties.

With successful payment to MeteoraActivities, the payment obligations to the Supplier are considered fulfilled.

We are your contact for matters concerning the Service Agreement and payment, acting as an intermediary between the Customer and the Supplier. If you wish to request a refund of the Booking Price outside the cancellation restrictions we have established, you can contact us. We will then communicate with the Supplier, who will decide on a case-by-case basis whether to grant the refund request. Refunds approved by the Supplier can be processed either by the Supplier directly or through us.

It is your responsibility to provide payment information honestly and to update it promptly in case of changes. The available payment methods for each Activity will be presented to you during the ordering process.

By authorizing payment, you consent to the use of your payment information for collecting payments for the Supplier. Additionally, we reserve the right to make the use of the payment function or individual payment methods on the Platform dependent on the necessary credit checks.

Cancellation and Booking Changes Policy

You can cancel the Service Agreements only according to the terms/policy of cancellation as stated and described on the Meteoraactivities platform. To avoid misunderstandings, for last-minute cancellations, which may represent significant losses for our Partners as well as changes you need to make (e.g. rescheduling the Activity date or changes in participants), these can be done through the form available in the "Contact us" section via the Meteoraactivities Platform, which must be made in a timely manner.

"Timely" means within the current cancellation period and may be subject to availability of the Activity. The decisive factor for timely cancellation is the timely receipt of notification from and to Meteoraactivities. If these conditions are met, we will issue a cancellation/change confirmation on behalf of the Supplier. This will serve as proof of cancellation/change and, therefore, must be kept.

We may notify you of changes or cancellations on behalf of the Supplier, especially if it's for a short period of time, via the phone number you have provided and by sending changes to your email address.

The following cancellation conditions apply unless otherwise specified in the activity descriptions: a) If the cancellation is made more than 48 hours before the start of the activity - reservation, the customer is entitled to a full refund of the reservation price. b) If the cancellation is made more than 24 hours but up to 48 hours before the start of the activity - reservation, the customer is entitled to 50% of the reservation price. c) If the cancellation is made less than 48 hours before the start of the activity - reservation, no refunds are provided.

If the customer wishes to change the scheduled dates of an activity, if such modification is possible, it can be made through the Meteoraactivities platform in the "Contact us" section. We will contact the Partner to see if such a modification is feasible on your behalf. If the modification request is accepted by the Partner, a new booking confirmation will be issued and sent to you.

However, please note that Partners are not obliged to accept date or schedule changes. Furthermore, it may not be possible to make the change for various reasons that cannot be predicted in advance. These requests, if accepted, may be subject to additional charges, according to the specific terms and conditions of the Partners.

If the modification request is rejected, your request will be treated as a cancellation, according to the above policy.

Please contact us or the Partner as soon as possible if you are unable to attend the activity on the specified date. Partners and Meteoraactivities will make every effort to find the best solution to reschedule or postpone your activity.

A refund provided by the Supplier may be processed by the Supplier through us.

Furthermore, in relation to the above, users should install and use security systems and programs on their computers to contribute to data protection on their part. However, it is important to note that, even with these measures, absolute security cannot be guaranteed.

The invalidity of any part of this does not imply the invalidity of the whole, but only of the specific part deemed invalid. The remaining terms remain in effect. Additionally, in this case, MeteoraActivities is committed to replacing the invalid part as soon as possible with a new term that is similar and based on good faith and commercial practices, to ensure the smooth operation of the platform and effective service to its users.

User Reviews and Other Content

We offer users the ability to view and submit reviews and other content posted by other users on the MeteoraActivities platform. Reviews represent the personal opinion of each user at a specific point in time and may vary depending on their personal expectations and experiences. It is also noted that the status of the activity may have changed since the review was published. Finally, the overall picture is usually formed by considering the number of reviews, as an individual opinion does not always reflect the complete experience.

You can play an active role in the platform's content by writing reviews or posting photos of the services or activities you have purchased. Please note that you are fully responsible for the content you post as a user. Posting content that is false or misleading, promotes products or services directly or indirectly, is created in exchange for compensation from third parties, violates intellectual property rights or privacy, or contains links or similar information that may affect the functionality of third-party data processing systems is strictly prohibited.

Before uploading any user content to the MeteoraActivities platform, make sure you have the necessary rights to use the images. This includes obtaining consent from individuals depicted in the photos before publishing them. Additionally, if you wish to use photos taken by others, you should obtain their consent.

User Content must comply with all applicable legal provisions and respect good morals, as well as the rights of third parties. Strictly prohibited is the uploading or posting of user content that includes violence, pornography, discrimination, insults, racism, defamation, or other illegal content.

All User Content you create remains under your ownership. You grant MeteoraActivities a non-exclusive, sublicensable (through multiple tiers), worldwide, fully paid, and royalty-free license to use the User Content. This license covers all media that are now known or will be discovered or developed in the future, including but not limited to use, reproduction, adaptation, translation, creation of derivative works, modification, performance, public display, public performance, transmission, and distribution of the User Content. This license also covers the use on the MeteoraActivities Platform or through it, to MeteoraActivities partners, as well as in online and offline marketing materials.

MeteoraActivities, along with affiliated companies, secondary representatives, and partners, reserve the right to display advertisements and other information alongside or together with User Content on the Platform, as well as on other media. No compensation is provided for these advertisements. Additionally, we reserve the right to make changes to the type and scope of these advertising actions without prior notice.

Compensation

You will fully indemnify us for all damages and expenses (including reasonable legal defense costs) arising from us, our representatives, or our partners, as a result of:

a) Intentional or negligent misrepresentation, act, or omission on your part, in relation to your use of the MeteoraActivities platform.

b) Intentional or negligent non-compliance with our Terms and Conditions.

c) Claims brought by third parties arising from or in connection with your access to or use of the MeteoraActivities platform, which violate intentionally or negligently its Terms and Conditions.

3.5

Risk & Cancellation Clause

If any provision of these Terms and Conditions of the MeteoraActivities platform is or becomes void or unenforceable, in whole or in part, this shall not affect the validity of the remaining provisions. Void or unenforceable provisions shall be replaced by applicable legal rules. If the applicable legal rules are inadequate or lead to an unacceptable result, the contracting parties shall negotiate to replace the void provision with a valid one, which as closely as possible achieves the economic purpose of the void provision.

Service Provision Agreement between User/Client & Partner/Supplier

When you select and purchase a Service/Activity on the MeteoraActivities Platform, you enter into a contract directly with the Partner/Supplier. At the time of contracting, we act as an intermediary electronic gateway between Suppliers and Visitors, having been authorized by the Suppliers to conduct transactions directly between them, such as reservation and payment management.

After checking the availability of the Service/Activity you have selected, you will be asked for additional mandatory information, such as some personal details, payment method, etc., in order to complete the reservation.

By clicking the "Pay now" button at the end of the ordering process, you submit a binding offer to purchase the service from the supplier. This offer is valid for two business days. After submitting the offer, you will receive an automatic order confirmation from the supplier. This confirmation does not constitute acceptance of the offer.

Partners/Suppliers have the ability to add their own terms and conditions to their listings on the MeteoraActivities platform. We recommend that you carefully read these terms and conditions, as they may contain important information for you. However, none of these terms and conditions will affect your relationship with us or your legal rights.

Once we receive a reservation confirmation in the name and on behalf of the supplier, we accept the offer on behalf and for the account of the supplier. In case of confirmation, you will have access to a coupon or a ticket, either as a mobile coupon or as a PDF with the option to download a voucher or ticket, as well as a payment confirmation. Additionally, we reserve the right to accept or reject contract offers at our sole discretion.

The contract between you and the supplier is not formed through a separate contract text. The content of the contract arises from the order product, i.e., from the description of the activity you selected, the applicable provisions in section 15 of these General Terms of MeteoraActivities Platform Provision, as well as, accordingly, from the terms and conditions of the supplier.

It is important to immediately check the order confirmation to ensure that all data has been entered correctly.

The Prices announced by the Suppliers may be subject to special provisions, such as cancellation and refund policies. Therefore, it is important to check independently before booking whether the respective Supplier provides different conditions.

Before the start of the Activity, it is important to appear promptly at the meeting point specified by the Supplier. Please note that you should carefully review the terms and conditions of the Supplier before booking. If you are traveling from abroad, you are responsible for organizing the necessary travel documents and complying with health requirements.

Please note that the reservation price does not include any kind of insurance. It is your responsibility to obtain adequate insurance. We recommend that you obtain travel insurance, especially if the Activity involves outdoor or high-risk activities. Please note that we do not set safety standards for Activities.

Partners/Suppliers operate as independent contractors and are not representatives or employees of MeteoraActivities. We are not responsible for the acts, errors, omissions, statements, warranties, breaches, negligence, or misconduct of any Partner/Supplier. Additionally, we are not liable for injuries, death, property damage, or other damages or expenses arising from or related to any reservation or Activity.

For the calculation of time and deadlines, the time zone of the Supplier applies.

In the event that weather conditions, official measures, strikes, or other unforeseen external circumstances beyond the control of the Supplier (especially force majeure events) make it impossible or significantly hinder or endanger the performance of the Activity, the Supplier reserves the right to cancel the Activity without a cancellation period. In this case, the reservation fee paid for the canceled Activity will be refunded, without any request for additional compensation from the Supplier or the MeteoraActivities Platform.

The Supplier reserves the right to exclude you from an Activity if: (a) you do not meet the participation requirements specified on the MeteoraActivities Platform, (b) you endanger yourself or others through your participation, or (c) you disrupt the implementation of the Activity in any way. In these cases, the reservation fee paid for the Activity will not be refunded.

The Supplier reserves the right to make substantive changes to the schedule of the Activity at any time if it deems it necessary due to unforeseen circumstances that arise within a short period of time. These changes may include changing the starting/meeting point for the Activity, provided that the customer has the opportunity to reach the new meeting point within a specific time period (10 minutes). This change may be made at any time before the scheduled start of the Activity, and we will inform you of it either via email or through the MeteoraActivities Platform.
